Carl Dustin Pistole, 35, pleaded guilty to voluntary manslaughter and robbery. The judge sentenced him to 16 years in prison with an additional 5 years of indefinite jail time for a total of 16-21 years.
During the trial, Pistole admitted to voluntary manslaughter and robbery for his actions toward Misty Montgomery, 43.
A woman, later identified as Misty Sue Montgomery of Lucasville, Ohio, was found lying on the side of Robert Lucas Road just east of U.S. 23 on December 30, 2020.
Several motorists noticed the woman in the road and intervened in order to provide aid and call 911. After being transported to Southern Ohio Medical Center, Ms. Montgomery succumbed to her injuries despite immediate lifesaving efforts.
The cause of death was determined to be blunt force trauma of unknown origin.
In the days and hours leading up to Misty Montgomery’s death, numerous witnesses had reported seeing her with Carl Dustin Pistole, a male acquaintance of hers.
Despite evading authorities for several days, Pistole was eventually captured by law enforcement about a week later.
An investigation was conducted by Ohio Highway Patrol officers and partner agencies. According to the investigation, Pistole was responsible for Montgomery’s injuries.
Judge Howard H. Harcha, III of the Court of Common Pleas accepted the plea and sentenced Mr. Pistole as recommended jointly by the prosecution and the defense. Scioto County Prosecutor Shane Tieman and assistant prosecutor Matthew Loesch represented the State of Ohio.
Christine Scott represented Pistole at the trial.
